This page defines the terms of your relationship with The Mining Almanac ("MA"), the proprietor of this website.
Terms
A. Your use of this website (the "Site") is subject to the terms of a legally binding agreement ("Agreement") between you and MA in relation to your use of this Site, and the terms and conditions of such Agreement (the "Terms") are set forth on this page. You may wish to print a copy of these Terms for your records.
B. In order to use this Site, you must first agree to the Terms, and you may not use the Site if you do not accept the Terms. You can accept the Terms by your use of the Site, and you agree that MA will treat your use of this Site as acceptance of the Terms that that point forward. A. MA is constantly updating the Site in order to provide you with an optimal experience. You acknowledge and agree that the Site may change from time to time without MA providing you with prior notice.
B. You acknowledge and agree that MA may, without prior notice, stop making this Site available to you, either temporarily or permanently. You may stop using the Site at any time. You do not need to inform MA when you stop using the Site.
C. You agree that any information that you provide to MA will be accurate, correct, and current.
D. You agree to use the Site only for purposes permitted by the Terms and any applicable law, regulation, or generally accepted practices.
E. You agree that you will not sell, resell, trade, reproduce, duplicate, or copy information from the Site for any purpose.
F. You agree that you are solely responsible for (and that MA has no responsibility to you or to any third party for) any breach of your obligations under the Terms and for the consequences (including any loss or damage which MA may suffer) of any such breach.
Site Content
A. You acknowledge that all information which you may have access to through your use of the Site ("Content") is the sole responsibility of the person from which such content originated.
B. You agree that you are not permitted to sell, distribute, rent, lease, modify, or create derivative works based on this Content (either in whole or in part) unless you have signed a separate agreement with either MA or the owners of such Content.
C. You agree that MA has a sole right (but not an obligation) to review, edit, refuse, or remove any or all Content from the Site.
D. You agree that you are solely responsible for (and that MA has no responsibility to you or to any third party for) any Content that you provide to MA for display on the site, and for the consequences of your actions (including any loss or damage which MA may suffer) by doing so.
E. You agree that the content of MiningAlmanac.com is for general information urposes only and does not constitute investment advice or advice of any other kind. MiningAlmanac.com tries to provide content that is true and accurate as of the date of publication; however, we give no assurance or warranty regarding the timeliness, accuracy, or appropriateness of any of the content. Ownership of the Site and the Content
A. You agree that MA owns all legal right, title, and interest in and to the Site.
B. Other than the limited license set forth in the next paragraph, MA acknowledges and agrees that it obtains no right, title, or interest from you (or your licensors) under these Terms in or to any Content that you submit, including any intellectual property rights which subsist in that Content. You agree that you are responsible for protecting and enforcing those rights and that MA has no obligation to do so on your behalf.
You retain copyright and any other rights you already hold in Content which you submit to the Site. By submitting the content, you give MA a perpetual, irrevocable, worldwide, royalty-free, and non-exclusive license to reproduce, adapt, modify, publish, and distribute any such Content. You confirm and warrant to MA that you have all of the rights, power, and authority necessary to grant the above license.
Ending your relationship with MA
A. The Terms will continue to apply until terminated by either you or MA. If you want to terminate your legal agreement with MA, you may do so by ceasing to use the Site. MA may, at any time, terminate its legal agreement with you if (i) you have breached any provision of the Terms, (ii) it is required to do so by law, (iii) it has any other reason, or none at all.
B. Upon termination of these Terms, all of the legal rights, obligations, and liabilities that you and MA have benefited from, been subject to (or which have accrued over time whilst the Terms have been in force), or which are expressed to continue indefinitely, shall be unaffected by this termination.
Exclusion of warranties
A. Nothing in these Terms shall exclude or limit MA's warranty or liability for losses which may not be lawfully excluded or limited by applicable law.
B. You agree that your use of this Site is at your sole risk and that the Site is provided "as is" and "as available." In particular, MA does not represent or warrant that (i) your use of the Site will meet your requirements; and (ii) the Content will be accurate, reliable, or updated in a timely fashion, if at all. Furthermore, MA specifically disclaims (i) that any Content shall create any warranty not expressly stated in the Terms and (ii) all warranties and conditions of any kind, whether express or implied.
Limitation of liability
A. You understand and agree that MA shall not be liable to you for any claims, losses, demands or damages of any kind whatsoever that you may incur, however caused and under any theory of liability, from your use of this Site or its Content. This limitation shall apply whether or not MA has been advised of or should have been aware of the possibility of any such losses arising.
Advertising
A. In consideration for MA granting you access to the Site, you agree that MA may place advertising on the Site.
Company Promotions
A. MA accepts payments from some companies in our database in exchange for increased exposure on this website. You agree that these promotions (including but not limited to profiles, research reports, distribution of materials, highlighted appearance in our datagrid, and a presence on the front page) in no way constitute endorsements or recommendations.
Links to other sites and content
A. The site includes links to other web sites and content, and MA may have no control over any of such web sites and content. You acknowledge and agree that MA does not endorse any advertising, products or services, or other materials on or available from such web sites. You further acknowledge and agree that MA is not liable for any loss or damage which you might incur as a result of the availability of those external sites, or as a result of your use of any of the products and/or services offered on such external sites.
Changes to the Terms
A. Whenever MA makes changes to the Terms, it will place a copy of the revised Terms on this Site.
B. You understand and agree that if you use the Site after the date on which the Terms have been changed, MA will treat your use as acceptance of the revised Terms.
C. The Terms constitute the whole legal agreement between you and MA and govern your use of the Site, and they completely replace any prior agreements between you and MA in relation to the Site.
Other matters
A. If any court of law having the jurisdiction to decide on this matter rules that any provision of these Terms is invalid, then that provision will be removed from the Terms without affecting the rest of the Terms. The remaining provisions of the Terms will continue to be valid and enforceable.
B. The Terms, and your relationship with MA under the Terms, shall be governed by the laws of Hong Kong without regard to its conflict of laws provisions. You and MA agree to submit to the exclusive jurisdiction of the courts located within Hong Kong to resolve any legal matter arising from the Terms.
Forum and blog disclaimer:
All messages made available as part of forum and blog discussions and any opinions, advice, statements or other information contained in any messages posted or transmitted by any third party are the responsibility of the author of that message and not of the Mining Almanac (unless the Mining Almanac is specifically identified as the author of the message). The fact that a particular message is posted on or transmitted using this Site does not mean that MA has endorsed that message in any way or verified the accuracy, completeness or usefulness of any message. We encourage visitors to the forum to report any objectionable message to reportabuse@miningalmanac.com. Discussions and comments are not monitored actively.
